These Terms & Conditions ("Terms") govern access to and use of Approve2Go, a digital health and safety forms platform for mine sites, provided by MineDesk ("MineDesk", "we", "us"). By creating a trial account, adding a paid subscription, or otherwise using Approve2Go, the company and individual doing so ("you", "your company") agree to these Terms.
Approve2Go lets your company create digital versions of safety forms (such as Take 5 pre-task risk assessments and equipment checks), have your workforce complete them, and route them through your company's own approval workflow. Approve2Go is a tool to help you run your existing safety processes digitally — it does not replace your company's own safety management system, your obligations under work health and safety law, or the professional judgement of your safety personnel.
Your company's Admin account holder is responsible for the accuracy of information provided during signup, for managing employee accounts (including PINs and login credentials) within your company, and for ensuring only authorised personnel are given access. You're responsible for activity that occurs under your company's Approve2Go account, other than activity resulting from our own failure to meet these Terms.
We may offer a free trial period. At the end of a trial, continued access requires an active paid subscription. We may change trial length or availability at any time. Demo accounts seeded into a trial company exist for evaluation only and should not be used to store real safety data you intend to keep.
Paid subscriptions are billed monthly or annually in advance, at the rate shown for your selected plan tier at the time of purchase. All payments are processed by Stripe, a third-party payment processor — MineDesk never receives or stores your payment card details. By subscribing, you authorise recurring charges to your chosen payment method until you cancel.
Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You can cancel or change your plan at any time via the in-app Billing page, which opens Stripe's own secure billing portal; a cancellation takes effect at the end of the current billing period, and you retain full access until then.
Refund requests are considered on a case-by-case basis at MineDesk's discretion. Please note that, at present, if a payment is refunded or successfully disputed (chargeback), your company's Approve2Go access is suspended immediately as part of that process, separately from any billing-period entitlement you might otherwise have had. If you believe a suspension following a refund or dispute was made in error, contact us via the in-app Contact Us form or at enquiry@minedesk.com.au and we'll review it.
You agree not to: use Approve2Go for any unlawful purpose; attempt to gain unauthorised access to another company's data or accounts; interfere with or disrupt the integrity or performance of the service; reverse-engineer or attempt to extract the underlying source code except as permitted by law; or use the service to store or transmit content that is unlawful, defamatory, or infringes another party's rights.
As between you and MineDesk, your company owns the data you and your workforce put into Approve2Go — form submissions, employee records, and related content ("Customer Data"). We process Customer Data only to provide, maintain, and improve the service, and as described in our Data Processing Agreement, which forms part of these Terms. You're responsible for the accuracy of Customer Data your company enters, and for having any necessary consents from your employees to store their information in Approve2Go.
Approve2Go's software, design, and branding are owned by MineDesk. These Terms don't transfer any ownership of that intellectual property to you — you receive a limited right to use the service for your company's internal purposes for as long as your subscription (or trial) is active.
We aim to keep Approve2Go available and reliable, but we don't currently offer a formal uptime service-level agreement. We'll make reasonable efforts to notify you of planned maintenance that may affect access. Support is available via the in-app Contact Us form or enquiry@minedesk.com.au.
Approve2Go is provided "as is". To the maximum extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including any implied warranty of merchantability or fitness for a particular purpose. Approve2Go is a records and workflow tool — it does not itself assess, certify, or guarantee the safety of any task, site, or piece of equipment; that responsibility remains with your company and your qualified safety personnel at all times.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted, or modified.
To the maximum extent permitted by law, MineDesk's total liability arising out of or in connection with these Terms or your use of Approve2Go is limited to the fees paid by your company for the service in the 12 months preceding the event giving rise to the claim. MineDesk is not liable for indirect, consequential, or special loss, including loss of profits or business interruption, except where such liability cannot lawfully be excluded.
Each party agrees to keep the other's confidential information confidential and to use it only as needed to perform under these Terms, except where disclosure is required by law.
Either party may terminate by ceasing use of the service and, for paid subscriptions, cancelling via the Billing page. We may suspend or terminate access for a material breach of these Terms, including non-payment, that isn't remedied after reasonable notice. On termination, your right to access Approve2Go ends; see the Data Processing Agreement for how Customer Data is handled afterward.
We may update these Terms from time to time. Material changes will be reflected by a new version date above, and continued use of Approve2Go after a material change constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Western Australia, Australia, and each party submits to the non-exclusive jurisdiction of the courts of Western Australia.
